WHAT IS AN "UNCONTESTED" DIVORCE THAT BRUCE GALLOWAY LAW WOULD HANDLE?

Both spouses agree on the essential points of the divorce:

  • Where the children will spend their time
  • Who gets what property
  • Who pays the debts

HOW MUCH DOES AN UNCONTESTED DIVORCE COST IN MISSOURI?

The cost of uncontested divorce depends on whether property or children are involved, and a county filing fee which varies by location.

Uncontested divorce with NO children

If you and your spouse's total assets are under $250,000, regardless of the value of your debt (including mortgage), the fee is $1,500.
OR If you and your spouse's total assets are over $250,000, or one of your income's is over $100,000, the fee will scale with asset value.

Uncontested divorce WITH children*

If you and your spouse's total assets are under $250,000, regardless of the value of your debt (including mortgage), the fee is $2,000.
OR If you and your spouse's total assets are over $250,000, or one of your income's is over $100,000, the fee will scale with asset value.

*all children of the spouses must have been born not later than 6 months of the date of the marriage

WHAT IS A FILING FEE?

Each county court system charges a fee for the privilege of accessing the courts for the purpose of getting a divorce. Filing fees range from $90.00 to $200.00, depending on the county.

WHAT ARE THE HIDDEN FEES FOR AN UNCONTESTED DIVORCE?

Most law offices charge extra for work they should include, like creating deeds, title transfers and QDRO's (which divide retierment plans).  They will push your bill up.  When you hire Bruce Galloway Law to handle your case, we pay all costs and there are NO Hidden Fees.

WHAT COUNTY DO I HAVE TO FILE MY DIVORCE IN?

When child custody is an issue, the divorce has to be filed in the county where the children reside. Also, real estate may only be divided in the state where is it located.

HOW LONG DOES AN UNCONTESTED DIVORCE TAKE?

About 120 days from beginning to end. The process typically works like this:

  • We give you a homework assignment that gives us a list of your assets, debts,
  • When your return it, we usually take our firm about seven to ten business days to prepare your divorce papers.
  • Once divorce forms are filed with the court, there is a 30-day waiting period by state law.
  • After the 30 days lapse, we can ask the court to approve your divorce.
  • Your judgment becomes final 31 days after the court approves your divorce.
  • Usually, you do not have to appear in court to finalize your case.

CAN WE BOTH USE THE SAME DIVORCE LAWYER?

No. A lawyer should not represent both sides in a divorce or other family law cases.

That being said, if the parties agree on all the terms, one lawyer can prepare all the paperwork on behalf of one party and the other party may then seek his or her own divorce attorney to review the paperwork or they may decide that they are satisfied with the documents as drafted. However, it is extremely important for the non-represented party to be aware that the attorney represents one person only and cannot provide “legal advice” to the non-represented party.

  • Bruce Galloway Law does not handle any uncontested divorces that include allegations of abuse or neglect.  We sue abusers.
  • Income limit of $125,000.00 per spouse
  • Asset limit of $250,000.00
  • No tax or bankruptcy advice
  • No preparation of QDRO unless purchased separately
